1. Acceptance and scope
These Terms & Conditions (“Terms”) govern your access to and use of the SUMMIT Development website, official mobile applications, customer portals, and related digital services (together, the “Services”). By accessing or using a Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
If you use the Services for a company or another person, you confirm that you are authorized to accept these Terms on their behalf.
2. Eligibility and accounts
- You must have legal capacity to use the Services and enter any transaction you request.
- You must provide accurate, current information and keep it updated.
- You are responsible for protecting your credentials and for activity performed through your account, except where applicable law provides otherwise.
- Notify us promptly if you suspect unauthorized access. We may require identity verification to protect you, other customers, and the Services.
3. Nature of the Services
The Services may provide project information, customer records, progress updates, viewing or support requests, notifications, payment-related records, and other digital features. Availability may vary by project, account, device, location, and release.
Website and app content is provided for general information unless expressly incorporated into a signed agreement. Images, plans, dimensions, prices, availability, completion dates, and specifications may be illustrative, approximate, or subject to permitted change. A property reservation, purchase, payment plan, maintenance obligation, or other legal commitment exists only under the applicable signed documents and official receipts.
4. Acceptable use
You must not, and must not help another person to:
- Use the Services unlawfully, fraudulently, or to infringe another person’s rights.
- Access another person’s account or data without authorization, misrepresent your identity, or submit false or misleading information.
- Probe, disrupt, overload, damage, bypass security controls, introduce malicious code, or interfere with the Services or connected systems.
- Copy, scrape, frame, reverse engineer, or commercially exploit the Services except where applicable law expressly permits it.
- Upload content that is unlawful, harmful, infringing, or contains malware.
5. Your content
You retain ownership of content you submit. You grant SUMMIT Development a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and share that content only as reasonably needed to operate the Services, complete your requests, comply with law, and protect our rights. You confirm that you have the rights and permissions needed to submit the content.
6. Intellectual property
The Services, branding, designs, text, software, images, and other materials supplied by us are owned by or licensed to SUMMIT Development and are protected by applicable intellectual-property laws. Except for the limited right to use the Services under these Terms, no rights are transferred to you. You may not use our names, logos, or marks without prior written permission.
7. Communications and device features
You agree that we may send operational communications necessary for your account or requested services. Marketing communications are subject to your choices and applicable law. Your carrier or internet provider may charge data or messaging fees. Optional features may require device permissions, which you can manage in your device settings.
8. Third-party services
The Services may link to or interoperate with third-party websites, maps, telephone, email, payment services, social networks, or WhatsApp. We do not control third-party services and are not responsible for their availability, content, security, or separate terms. Your use of them is governed by their own agreements.
9. Availability and updates
We may maintain, update, change, suspend, or discontinue features where reasonably necessary. We do not promise that every Service will always be available or error-free. App updates may be required for continued secure use. We are not responsible for failures caused by your device, connectivity, third-party services, or events beyond our reasonable control.
10. Suspension and termination
You may stop using the Services at any time and may request account deletion as explained in the Privacy Policy. We may restrict or suspend access where reasonably necessary to protect users or systems, investigate suspected misuse, comply with law, or address a material breach of these Terms. Clauses that by their nature should survive termination will remain effective.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided on an “as available” basis. We disclaim warranties that are not expressly stated in these Terms or a signed agreement. Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded, and nothing here changes SUMMIT Development’s obligations under a signed property or customer agreement.
12. Limitation of liability
To the fullest extent permitted by law, SUMMIT Development will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of the digital Services, including loss of data, opportunity, or profit. This limitation does not apply to liability that cannot legally be limited, or to obligations expressly accepted in a signed agreement.
13. Governing law and disputes
These Terms are governed by the laws of the Arab Republic of Egypt, without prejudice to mandatory consumer protections that apply to you. Please contact us first so we can try to resolve any concern. Courts with jurisdiction under applicable Egyptian law may hear unresolved disputes.
14. Changes to these terms
We may update these Terms to reflect changes in the Services, law, or business practices. We will publish the updated version here, change the effective date, and provide additional notice where required. Continued use after the updated Terms take effect constitutes acceptance to the extent permitted by law.
15. General terms
If any provision is unenforceable, the remaining provisions remain effective. A delay in enforcing a provision is not a waiver. You may not transfer your rights under these Terms without our consent. We may transfer our rights and obligations as part of a restructuring or business transfer, subject to applicable law. These Terms and the Privacy Policy form the agreement for use of the digital Services, while signed transaction documents separately govern property and customer transactions.
